One problem you may encounter with a "stealth" EULA is the same reason 
you can get a refund on Windows in some states: If the user of the 
service cannot read the EULA, then they cannot knowingly agree to abide 
by the conditions contained in the EULA.  IANAL, nor do I know Ohio law 
on the subject, but it seems to me like that could be, potentially, a 
very large issue.
