While you are at it, file a complaint to your Better Business Bureau. 
File a complaint with the Federal Trade commission as well. I recently 
filed a complaint with the FTC and was surprised that I got a pretty 
quick response from them, and the company in question as well.

Talking points to the company are:

I will sue.

This could turn into a class action suit.

Lawyers will work on a commission basis, meaning you pay them no money. 
They get part of the settlement. You pay nothing if they loose. Remind 
the company of this.
